Short answer: usually not for ordinary soil movement or settling. The Texas Department of Insurance says damage to foundations or slabs is one of the common endorsements (add-ons) companies offer, and most policies don't cover a continuous water leak or wear and tear. Foundation damage caused by a sudden, accidental plumbing leak may be covered depending on your policy form. Read your declarations page and ask your agent.

What Texas policies usually cover and exclude

Plumbing leaks under the slab

In Balandran v. Safeco Insurance Co. of America (1998), the Texas Supreme Court held that the older Texas standard HO-B policy covered foundation damage caused by an accidental plumbing leak, even though the policy generally excluded settling and cracking (Balandran v. Safeco, Tex. 1998). Many current policies are written differently, which is why TDI points homeowners to the foundation/slab endorsement. Whether your own policy covers a slab leak depends on its exact wording.

What to do if you suspect a covered loss

  1. Read your declarations page for a foundation or slab endorsement and its limit.
  2. Call your agent or insurer before repairs start, and ask what they need: photos, a plumbing leak test, an engineer's report.
  3. Keep records: crack photos with dates, leak test results, repair invoices.
  4. Fix the cause. If a plumbing leak moved the soil, the leak needs repair too.
